1. INFORMATION TO THE USER

Who is responsible for processing your personal data?
FUNDACION NURIA GARCÍA PARA LA INFANCIA will be responsible for processing the personal data of those INDIVIDUALS who have created a profile on any of its social media platforms. These data will be processed in accordance with Regulation (EU) 2016/679, dated 27 April (GDPR), Organic Law 3/2018, dated 5 December (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI), providing the following information on the data processing:

What is the purpose of processing your personal data?
Purpose of Processing: To maintain a relationship between the USER and FUNDACION NURIA GARCÍA PARA LA INFANCIA (hereafter referred to as the CONTROLLER), which may include the following activities:

  • Processing requests and enquiries submitted to the controller.
  • Providing information about activities and events organised by the controller.
  • Providing information about products or services offered by the controller.
  • Interacting through official profiles.

When the CONTROLLER collects and processes personal data through its social media profiles, USERS will be informed about the purpose of data collection and their rights regarding their personal data. Personal data will only be used for the specified purposes and will be kept securely.

Legal Basis for Processing: The explicit consent given by the USER for the processing of their personal data for one or more specific purposes (Article 6.1.a of the GDPR).
Additionally, the USER can access the privacy policies of the social media platform at any time and configure their profile to ensure privacy.

How long will we retain your personal data?

Data retention criteria: they will be kept as long as the USER does not revoke the consent given, as stated in this privacy policy.

Who do we share your personal data with?
Data sharing: The information provided by the USER through the RESPONSIBLE party’s social media, including their personal data, may be published depending on the services used by the USER. Therefore, it may become publicly available to other third-party users of the social media platforms. From each social media profile, the USER can configure which information they wish to make public in each case, view the permissions granted, delete or deactivate them, as well as any third-party applications they no longer wish to use.

However, there is no intended sharing of personal data with third parties outside of the social media platform unless it is essential for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the RESPONSIBLE party has signed confidentiality agreements and data processing contracts required by current privacy regulations.

What are your rights?
Rights of the USER: They can only be fulfilled in relation to the information that is under the control of the DATA CONTROLLER.

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability, and deletion of your data, and to limit or object to its processing.
  • Right to file a complaint with the supervisory authority (www.aepd.es) if you believe the processing does not comply with the applicable regulations.

2. USE OF THE PROFILE

The RESPONSIBLE PARTY will carry out the following actions:

  • Access to the public information on the profile.
  • Publication on the USER’s profile of any information already published on the RESPONSIBLE PARTY’s social media.
  • Sending personal and individual messages through the social media channels.
  • Updates on the page’s status to be posted on the USER’s profile.
    The USER can always control their connections, delete content that no longer interests them, and restrict who they share their connections with. To do so, they must access their settings, where they will find different configuration options regarding the privacy level of their social media profile.

 

3. PUBLICATIONS

The purpose of social media is to provide visibility and promote the activities carried out by the RESPONSIBLE PARTY. These tools store personal data on the servers of the respective services and are governed by their own privacy policies.

Once the USER follows or joins the RESPONSIBLE PARTY’s social media, they can post comments, links, images, photographs, or any other type of multimedia content supported by the platform. The USER must, in all cases, be the owner of the content posted, hold the copyrights and intellectual property rights, or have the consent of any third parties involved.

Any publication on the social media platform, whether texts, graphics, photographs, videos, etc., that offends or could offend moral standards, ethics, good taste, or decorum, and/or infringes, violates, or breaks intellectual or industrial property rights, the right to one’s image, or the law, is strictly prohibited. Offensive, defamatory, illegal, or inappropriate comments or content will not be tolerated on the company’s profiles. The company reserves the right to delete such comments or content and block the responsible users.

In these cases, the RESPONSIBLE PARTY reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The RESPONSIBLE PARTY will not be held responsible for the content freely posted by the USER.

The USER should be aware that their posts will be visible to other users, so they are primarily responsible for their privacy.

Any images posted on social media will not be stored in any file by the RESPONSIBLE PARTY, but they will remain on the social media platform.

 

4. DATA OF MINORS OR PERSONS WITH SPECIAL NEEDS

It is recommended to review and read the terms of use and privacy policies of each social media platform at the time of registration, considering the different age requirements for such registration.

Furthermore, the RESPONSIBLE PARTY will be expressly exempt from any liability arising from the use of social media by minors or persons with special needs, whose access should be carried out under the supervision and control of their legal representatives.

The RESPONSIBLE PARTY reserves the right to modify this policy at any time. Any changes will be communicated through our social media profiles and/or our website.
